Blue Cross Blue Shield of Michigan on Friday appealed a U.S. District Court judge’s denial to dismiss a federal and state lawsuit against the insurer that alleges the Blues’ use of certain hospital contracts stifles competition and drives up costs for consumers.

The Blues have appealed to the U.S. Sixth Circuit Court after Detroit federal Judge Denise Page Hood said in June she was refusing the insurer’s request to dismiss the case, which was filed last fall by the U.S. Justice Department and former Michigan Attorney General Mike Cox.

Hood’s decision allowed the case, which has garnered national attention, to move forward.

The federal and state governments allege the Blue Cross Blue Shield of Michigan signed contracts with more than half of Michigan’s acute care hospitals that prevent them from charging other medical insurance companies lower prices, and in some cases the Blues agreed to boost reimbursement to hospitals if they charged competing insurance companies higher rates.

“It’s good for Michigan consumers for Blue Cross Blue Shield to be able to fairly negotiate hospital contracts that guarantee the lowest prices for millions of people,” said Helen Stojic, a spokesperson for the Blues, which has about 4.3 million Michigan members. “The federal government wants to deny us this ability to keep health care affordable, and we look forward to successfully defending it in court. This appeal is part of that process.”
